To: Oregon Contractors

Subject: You Just Got Kicked In The Teeth And Stripped Naked By Your General Liability Insurance Company!

I don’t usually use this type of language in a letter…but I ‘m outraged, and I don’t know how else to say it! Your, *&^%$&* insurance company has left you in the cold.

Effective December 15th, 2004, "certain" insurance companies will add a new exclusion to your general liability policy when it renews. This exclusion takes all coverage away from you if you do any work in connection with the pre-construction, construction, or post construction of any residential building. The new designated work exclusion is as broad as the ice berg that sank the Titanic! Just look at this description of what the insurer won’t cover!

“Residential building” to the "certain" companies means:

  1. Any single-family dwelling, including, but not limited to, houses, town homes or townhouses; or
  2. Any multi-family dwelling, including, but not limited to condominiums or cooperative, duplexes, triplexes or four-plexes and apartment buildings or complexes; or
  3. Any other structure, which is attached to, or ancillary to any structure identified in 1 or 2 above.

In short if you do any work in or around on any building, including the dog house, then there is no coverage for your work if it has any connection with a residential building.

Warning to all General Contractors

Do not accept a certificate of insurance from any sub-contractor without talking to us first!  "Certain" insurers have come right out and told me they do not want to insure residential contractors. If you accept a certificate of insurance from a sub-contractor, you have just put your insurance policy on the hook for any loss resulting from your subs work. You pay the price!
